Terms and Conditions

Version 2.0 · Effective date: [TO CONFIRM: date these terms take effect]

1. About these terms

Classified is a city-mission game played in your phone’s web browser. You follow clues to real bars and venues, check in when you arrive, and compete on time, on your own or with friends.

In these terms, “Classified”, “we”, “us” and “our” mean Classified Group Pty Ltd (ABN 82 701 944 578), 12/143 Kurraba Road, Kurraba Point, NSW. “You” means the person using Classified.

These terms are an agreement between you and us. They apply whenever you use Classified, including the player app, our website and any emails we send you. Our Privacy Policy explains how we handle your personal information and forms part of these terms.

When you create an account, you tick a box to confirm that you are 18 or older and that you agree to these terms and our Privacy Policy. By buying a mission or playing, you also agree to these terms. If you don’t agree, please don’t use Classified.

Nothing in these terms takes away rights you have under the Australian Consumer Law or any other law that can’t be excluded.

2. Who can use Classified

Classified is for adults. You must be 18 or older to create an account, buy a mission or play, because every venue on our routes serves alcohol. When you sign up, you confirm that you are 18 or older. We may ask for reasonable proof of age and may close an account that doesn’t meet it.

Classified takes place in licensed venues. Venues decide who they let in and serve, and may ask for ID. Being a Classified player doesn’t entitle you to entry or service at any venue.

Classified runs in Sydney, Melbourne, Brisbane and the Gold Coast, and in other Australian cities as we add them. The app shows which missions are available in each city.

3. Your account

You need an account to buy and play missions. You can browse missions without one.

You can sign up with your email address and a password, or with your Facebook account. When you sign up:

  • give accurate details, and keep your email address up to date so we can reach you about your missions;
  • choose a display name that doesn’t impersonate anyone, isn’t offensive and doesn’t include someone else’s personal details. Your display name can be seen by other players (see section 8);
  • keep your password private and don’t share your account. You’re responsible for what happens on your account unless it was used without your permission and you weren’t careless.

Tell us straight away at the address in section 20 if you think someone else has used your account.

Each account is for one person. Missions you buy are linked to your account and can’t be transferred to another account unless we agree.

4. Buying a mission

Prices. Each mission shows its price before you buy it. Prices are in Australian dollars and include GST. The price you see at checkout is the price you pay.

What a mission includes. A mission gives you access to that mission’s clues, map, check-ins, Handler and results for one play. Unless the mission description says otherwise, the price doesn’t include food, drinks, entry fees, bookings or transport.

Paying. Payments are processed by Stripe on Stripe’s own secure checkout page. Your card details go to Stripe, never to us. When Stripe confirms your payment, the mission is added to your account and Stripe emails you a receipt.

Discount codes. We may offer discount codes, including codes that make a mission free. Codes can only be used from a registered account, can have conditions (for example an expiry date or a limit on how many times they can be used) and have no cash value. A code may not be used if it was obtained or shared in breach of its conditions.

Group codes are not discount codes. Every player buys their own access to a mission. A group code lets you play with friends (section 8), but doesn’t give you access to a mission you haven’t bought.

When to play. Missions you’ve bought don’t expire: you can start one whenever you like. You can only play one mission at a time. Once you press start, you have a set time to finish it (see section 6).

5. Refunds and your consumer rights

Your rights under the Australian Consumer Law. Our services come with guarantees that can’t be excluded under the Australian Consumer Law. For a major failure with the service, you’re entitled to cancel your service contract and get a refund for the unused portion, or to compensation for its reduced value. If a failure with the service doesn’t amount to a major failure, you’re entitled to have problems with the service fixed in a reasonable time and, if this isn’t done, to cancel your contract and get a refund for the unused portion. You may also be entitled to compensation for other loss or damage that was reasonably foreseeable.

Change of mind. Missions you buy don’t expire, so if your plans change or the weather is bad, you can simply play another day. For that reason we don’t give refunds if you change your mind. This doesn’t affect your rights under the Australian Consumer Law.

Closed venues. If a venue on a route closes, we take it out of the mission.

Problems during a mission. If something on our side stops you finishing a mission (for example the app fails or a venue on the route is unexpectedly closed on the night), contact us. We’ll look into it and, where the problem was on our side, give you a fresh play of the mission or a refund.

How to ask. Contact us at the address in section 20 with your account email, the mission and what went wrong. Refunds go back to the original payment method.

6. How a mission works

Each mission is a set of clues, each leading to a venue. Before the first clue, the Handler briefs you on the rules for that mission. The briefing and the game screen tell you the time allowed for each clue, the number of attempts, when a hint becomes available, and any time penalties. These settings can differ between missions.

The play window. Once you start a mission, you have 24 hours to finish it, unless the mission says otherwise. If the window ends before you finish, the mission closes as incomplete and no leaderboard result is recorded. Locking your phone, closing the app or losing reception doesn’t pause the clock.

Clues, hints and reveals. You release each clue when you’re ready, and its timer starts then. If you run out of time or attempts, the answer and the venue’s address are revealed and a time penalty is added. Taking a hint adds a time penalty too.

Checking in. When you reach a venue, you check in in the app with a photo. Your arrival counts when your phone’s location shows you within the venue’s check-in area. If your location won’t register while you’re at the venue, you can ask our team for help in the app, and they can confirm your arrival. Help isn’t always immediate.

Between venues. After checking in you can stay at the venue for a set time before the next clue unlocks. That time doesn’t count towards your result.

Leaving a mission. You can leave a mission at any time. Leaving ends that play, and it can’t be resumed.

7. Answers, results and leaderboards

Our servers decide. Whether an answer is right, whether you’ve arrived, how much time is left and your final result are all decided by our systems, not by your phone.

Automatic answer checking. If your answer doesn’t exactly match an accepted answer, it’s checked automatically by an artificial intelligence service, which decides whether your wording means the same thing. It can make mistakes. The Handler may also use that service to reply to a wrong answer. Please don’t type personal information into answers. If you think an answer was marked wrongly, contact us with the mission, the clue and the time. We’ll review it and correct your result if we agree. Our Privacy Policy explains more about automated decisions.

Your result. Your result is your total time across the mission, plus any penalties. Time spent at venues between checking in and releasing the next clue isn’t counted.

Leaderboards. Each mission has an all-time leaderboard showing the display name, result and rank of each player who completed it, with their best result. Players who have bought that mission can see it. You can choose to hide your result from the all-time leaderboard in your profile. While playing with a group, members also see how they rank against each other at set points in the mission.

Fair results. We may remove a result, or remove a player from a leaderboard, if we reasonably believe it was achieved by breaking these terms (for example by faking location or sharing answers). We may also correct a result that was recorded wrongly because of an error.

8. Playing with other people

Friend groups. When you buy a mission you get a group code. Anyone with a member’s code can join that group for the mission, and the group can grow through any member’s code, without an approval step, up to the group size shown in the app. Only share your code with people you’re happy to play with.

Each player in a group plays at their own pace and answers their own clues.

What others in your group see. Members of your group can see your display name, profile photo, whether you’re online and your progress and results for the mission. While you’re actively playing a mission as part of a group, they can also see your location on the map (see section 10). If you don’t want to share your location with others, play solo.

Other players. Players on the same mission who aren’t in your group can see your display name and your rough location (not your exact position) while you’re both playing. You can send a contact request to another player, who can accept or decline. If they accept, they’re asked separately whether to share their email address or phone number with you. Nothing is shared without that choice. A contact request never adds anyone to your group.

Be decent. Treat other players with respect, online and in person. Meeting someone through Classified is your decision. Take the same care you would when meeting anyone new, and meet in public places. We don’t check other players’ identities or backgrounds.

Sharing. You can share your group code and your check-in photos by email or social media. When you do, the service you share to handles that copy under its own terms.

9. Your safety, venues and alcohol

Classified takes place on real streets and in real venues, often at night. You’re responsible for your own safety and choices.

  • Stop to read. Stop somewhere safe before looking at your phone or taking a photo. Never play while driving or riding.
  • Follow the road rules. Use footpaths and pedestrian crossings, watch for traffic, and don’t run or take shortcuts to improve your time. No clue requires you to enter a restricted or private area.
  • Trust your judgement. Decide for yourself whether a route is safe in the weather and conditions on the night. Stop if you feel unsafe or unwell, and arrange safe transport home. In an emergency, call 000.
  • Alcohol is optional. You never need to drink to play or to finish a mission. Drink responsibly, and don’t pressure anyone else to drink. Never drink faster to improve a time.
  • Venues set their own rules. Venues are independent businesses. They decide their opening hours, who they admit and serve, dress codes and photography rules, and they may ask for ID. Follow their staff’s directions. We’re not responsible for a venue’s decisions, but if a venue on your route is closed or refuses entry, tell us (see section 5).

Classified, its map and the group view aren’t a safety, navigation or emergency service.

10. Location, camera and your device

Location. Classified needs your phone’s precise location while the app is open. It’s used to show you on the map, to tell you how close you are and to confirm your check-ins. When you play in a group, your location is shared with your group while you’re actively playing (section 8). Classified only uses your location while the app is open on your screen; it doesn’t track you in the background. You can turn location access off in your browser or phone settings, but you won’t be able to check in without it.

Camera and photos. Checking in needs a photo, taken with your camera or chosen from your phone.

Location accuracy. Phone location is usually accurate to within 5 to 20 metres and can be less accurate near tall buildings. Check-in areas allow for this, but we can’t guarantee your phone will always report your position correctly.

Your device. You need a recent smartphone browser, mobile data and enough battery to finish the mission. Keep the app open on screen while playing. Data charges from your mobile provider are yours.

11. Your photos and content

Your content includes your check-in photos, profile photo, display name, feedback and anything else you add to Classified.

You own your content. You give us a non-exclusive licence to store, copy, display and process your content only as needed to run Classified: for example, to record your check-ins, show your profile photo to your group, and let our team confirm an arrival. This licence ends when your content is deleted, except for copies we must keep by law or that are in backups awaiting deletion.

Marketing use needs your permission. We’ll only use your photos or feedback in our marketing if you give us separate permission, for example by ticking the optional box in the feedback form at the end of a mission. That box is never ticked for you. You can withdraw that permission at any time (see the Privacy Policy). If you agree, we may use them on our website and social media.

Respect other people. Only upload photos you have the right to share. Ask before photographing people, avoid photographing children and strangers, and follow venue rules. Don’t upload anything unlawful, offensive or that reveals someone else’s private information. We may remove content that breaks these terms.

12. Rules of play

You must not:

  • fake or interfere with your location, or use tools or another person to check in for you;
  • share answers or clues publicly, or use them to give anyone an unfair advantage;
  • use someone else’s account, or create accounts to get around limits, bans or discount-code conditions;
  • harass, threaten, abuse or discriminate against other players, venue staff or our team;
  • try to access parts of Classified or information you aren’t allowed to see, test its security without our written permission, or disrupt it (for example with automated tools or excessive requests);
  • copy, resell or commercially use missions, clues or answers;
  • use Classified in a way that breaks the law or these terms.

13. Our content and brand

The missions, clues, answers, the Handler (including her character, artwork, animation and voice), the app, the Classified name and logo, and other material we provide are owned by us or our licensors. We give you a personal, non-transferable right to use them only to play Classified. You may share the branded images and codes the app gives you for sharing.

14. Other services we rely on

Classified uses other companies’ services, including Stripe for payments, Google Maps for maps, Facebook for Facebook sign-in, an artificial intelligence service for checking answers, and companies that host our app and data. Our Privacy Policy lists them. Using some features means also following those companies’ terms, for example Google Maps’ terms when you use our map, or Facebook’s terms when you sign in with Facebook.

We’re responsible to you for the Classified service. Venues and the services you choose to share content to (such as social media) are independent of us.

15. Changes to Classified and to these terms

Changes to Classified. We improve Classified over time and may change, add or remove features, missions, venues or routes. If a change significantly affects a mission you’ve bought but haven’t finished, we’ll tell you and offer a fair option, such as a replacement mission or a refund.

Availability. We aim to keep Classified available, but it may sometimes be unavailable, for example during maintenance or because of a problem with a service we rely on.

Changes to these terms. We may update these terms, for example to reflect new features or changes in the law. We’ll tell you about significant changes by email and in the app at least 14 days before they apply. Changes won’t affect missions you’ve already bought in a way that’s unfair to you. If you don’t agree with the changes, you can stop using Classified and close your account.

16. Suspending or closing an account

You can close your account at any time, in your profile or by contacting us. Closing your account ends your access to any missions on it, including ones you haven’t played yet.

We may suspend or close an account if we reasonably believe you’ve seriously or repeatedly broken these terms, put other people at risk, acted unlawfully or acted fraudulently (for example with payments or discount codes). Where it’s reasonable, we’ll tell you why and give you a chance to respond first. We may act immediately where there’s a risk to safety or security. Suspending or closing an account doesn’t remove any right you have to a refund under the Australian Consumer Law.

17. Our responsibility to you

We’ll provide Classified with due care and skill.

Subject to the next paragraph, and to the extent the law allows, we’re not responsible for loss that isn’t caused by our breach of these terms or our negligence, or that wasn’t reasonably foreseeable when you bought the mission, or for the acts of venues, other players or services we don’t control.

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t lawfully be excluded, including for personal injury or death caused by our negligence.

18. Complaints and disputes

If you’re unhappy with Classified, please contact us first at the address in section 20 and tell us what happened and what you’d like us to do. We’ll acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

If we can’t resolve it, you can contact your state or territory consumer protection agency (for example NSW Fair Trading or Consumer Affairs Victoria) or take the matter to a tribunal or court. For privacy complaints, see the Privacy Policy.

19. Governing law

These terms are governed by the law of [TO CONFIRM: state or territory]. You and we can bring proceedings in the courts of that state or territory, or in any other Australian court or tribunal that has jurisdiction.
